Legend Boats Brand Micro-Ambassador Program

A Legend Boat Brand Ambassador is an individual with a formal relationship with the Legend Boats brand as a representative and advocate. A Legend Boats  Brand Ambassador loves the product, uses the product, advocates for it organically and gets rewarded for such advocacy. 

Legend Boats and the Brand Ambassador agree to the following:

Appointment: Legend Boats would like the Brand Ambassador’s assistance in promoting / offering / selling Legend Boats products via their social media accounts. Legend Boats hereby appoints the  Brand Ambassador as its representative on a non-exclusive, non-employee basis to endorse and promote its services to the target audience.

Term: This Agreement shall have an initial term of one year  and shall automatically renew for additional one-year terms thereafter unless either party provides thirty days prior written notice of its intention of nonrenewal. 

Deliverables: The  Brand Ambassador will deliver the agreed number of posts on the agreed platforms on behalf of Legend Boats according to the delivery schedule specified by Legend Boats.  The Services shall conform to the specifications and instructions of Legend Boats as outlined in detail below.

As the Legend Brand Micro-Ambassador I agree to the following:

• Provides Legend Boats with a Google Review & Facebook Review.
• Maintain public profiles on all social channels.
• Join and be active in local community groups, answer community questions on social networks or via direct messaging, comments.
• Provide a photo and video montage at the end of the fishing season about the experiences with a Legend Boat – season recap – Get creative! This can look however you would like!
• Offer suggestions on new product design – new product ideas and features.
• Ensure a presence, and representation at 1 annual Legend Boats Event – with COVID-19 we currently are not aware of when shows will be up and running, so this is TBD.
• Daily interactions with all Legend Boats social channels: likes, shares, comments
• In all situations, social posts and articles will be communicated and/or written as professionally as possible. Refrain from engaging in discussions that may be deemed derogatory or unsportsmanlike. Obey and follow all rules and guidelines for boards, social, or similar networks or forums.
• Always obey all fishing, conservation and boating regulations and abide by all laws.

Failure to adhere to the above requirements will result in a thirty (30) day probation period at which time all fiscal discounts will be rescinded. Failure to adhere to the above requirements following a thirty (30) day probation period will result in immediate termination of my position.

If also acting as a ProStaff;

• We are your primary sponsor and will be the prominent logo for any interviews, media coverage, seminars etc., and have expectations that we are mentioned regularly and always highlighted as your primary sponsor.
• Legend shirts must be worn at all times during the Tournaments and events, don’t worry we can get you all the Legend gear you need.

Items to Avoid in Brand Ambassador Posts: The  Brand Ambassador agrees to avoid mentioning any and all competitors of Legend Boats. The Brand Ambassador agrees to abide by all guidelines set in the Brand Rule Guidelines. (For example, all blog posts, social media statuses, tweets, and/or comments should be in good taste and free of inappropriate language and/or any content promoting bigotry, racism or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age).

Approval and Content Origination: The Brand Ambassador understands that all promotions and products they promote as part of this agreement are controlled by Legend Boats. The Brand Ambassador assumes all responsibility for verifying that the campaign materials used meet Legend Boats approval.   

Confidentiality and Exclusivity: During the course of the Brand Ambassador’s performance of services for Legend Boats, the Brand Ambassador will receive, have access to and create documents, records and information of a confidential and proprietary nature to the Legend Boats and customers of the Legend Boats. The Brand Ambassador acknowledges and agrees that such information is an asset of Legend Boats or its clients, is of a confidential nature and, to preserve the goodwill of Legend Boats and its clients must be kept strictly confidential and used only in the performance of the Brand Ambassador’s duties under this Agreement. The Brand Ambassador agrees that he/she will not use, disclose, communicate, copy or permit the use or disclosure of any such information to any third party in any manner whatsoever except to the existing employees of Legend Boats or as otherwise directed by Legend Boats in the course of the Brand Ambassador’s performance of services under this Agreement, and thereafter only with the written permission of Legend Boats. Upon termination of this Agreement or upon the request of Legend Boats, the Brand Ambassador will return to Legend Boats all of the confidential information, and all copies or reproductions thereof, which are in his/her possession or control. The Brand Ambassador agrees that during the tenure of this contract, and for a three-month term afterward, the Brand Ambassador will not undertake  Brand Ambassador marketing for a competitor in the same vertical as Legend Boats.

Compensation:  While performing as a Legend Boats Brand Micro- Ambassador, Legend Boats through  it’s dealer will provide the following benefits and incentives, provided that the Brand Ambassador adhere to all policies and maintain my excellent standing as a Legend Boats Brand Ambassador: 

1. Exposure for their own social channels
2. Swag bag (hats, tshirts, hoodies, fishing jersey, towel, water bottle, keychain, decals etc)
3. Provide ten percent (10%) discount pricing for any Legend Boats parts and accessories, apparel, services and labour for your exclusive use. 
4. When requested, and in the event that you have a dedicated professional website, we will review on a case-by-case basis and provide “link-back” to the Legend Boats® webpage.
5. Opportunity to receive Legend Boats® logo items including, but not limited to hats, shirts, and stickers based on individual Pro Staff consistency of performance.
6. End of season $100 Legend Boats gift card *bonus*
   

In full consideration of the Brand Ambassador’s performance, his / her obligations and the rights granted herein, the Brand Ambassador shall be given the above compensation agreed upon between the  Brand Ambassador and Legend Boats.  The  Brand Ambassador will otherwise perform the services at his/her own expense and use his/her own resources and equipment. The  Brand Ambassador acknowledges that the agreed upon compensation represents the  Brand Ambassador’s entire compensation with respect to this agreement and Legend Boats shall have no other obligation for any other compensation to or expenses or costs incurred by the  Brand Ambassador in connection with the performance of its obligations under this agreement.

Force Majeure: If either party is unable to perform any of its obligations by reason of fire or other casualty, strike, act or order of public authority, act of God, or other cause beyond the control of such party, then such party shall be excused from such performance during the pendency of such cause.

Independent Contractor: The  Brand Ambassador is retained as an independent contractor of Legend Boats. The  Brand Ambassador acknowledges and agrees that (i) The  Brand Ambassador is solely responsible for the manner and form by which the  Brand Ambassador performs under this Agreement. 

Choice of Law: This Agreement shall be construed and enforced pursuant to the laws and decisions of the Province / Country.

Cancellation:  Either party may terminate this agreement upon ten days prior written notice if the other party breaches this agreement and does not cure such breach within such time period. In addition to any right or remedy that may be available to the Advertiser under this agreement or applicable law, In addition, in the event that the  Brand Ambassador has breached this agreement, Legend Boats may (i) immediately suspend, limit or terminate the  Brand Ambassador’s access to any Legend Boats account and/or (ii) instruct the  Brand Ambassador to cease all promotional activities or make clarifying statements, and the  Brand Ambassador shall immediately comply. Either party may terminate this agreement at any time without cause upon thirty days prior written notice to the other party.
